Our Commitment to a Clear and Professional Partnership
At Sigma Recruitment, our goal is to build a successful, long-term partnership with you. To ensure clarity and protect the interests of all parties—you, our clients, and our agency—we have set out the terms of our working relationship below.
These terms cover important areas like data protection, confidentiality, and our mutual obligations. They are designed to create a transparent and professional framework so we can focus on what matters: finding you the perfect role. If you have any questions, please do not hesitate to ask your consultant.
Important: By replying to our Job Information email/message with an affirmative response (such as ‘YES’, ‘OK’, ‘Yeah’, ‘Put me forward’, etc., case-insensitive), by providing the same response verbally when we ask for permission to present your details (and have previously sent you these Candidate Terms), or by agreeing via to these terms via any form, checkbox, electronic signature, portal, or other digital consent mechanism, you confirm you have read and agree to these Candidate Terms. Your affirmative response constitutes your signature and a legally binding agreement to these terms.

1. Right to Represent and No Guarantee
- You grant Sigma Recruitment Ltd (“Sigma”) an exclusive right to represent you to the named company for the specified role (and any substantially similar role) for 12 months from the date of your affirmative reply.
- Sigma has sole discretion whether to submit your CV. No submission, interview, feedback, or offer is promised or guaranteed.
2. Non‑duplication and Candidate Warranties
- You confirm that within the last 12 months you have not applied directly to, nor been presented by another party to, the named company for the same or a substantially similar role. You agree not to do so during the 12‑month exclusivity.
- You warrant that all information you provide to Sigma is complete, accurate, and not misleading, and that you will promptly update Sigma if circumstances change.
3. Confidentiality
- All information you receive from Sigma about roles, clients, or processes is confidential. You will not disclose it or use it for any purpose other than engaging with Sigma for the named role.
4. Data Protection and Controller Status
- Sigma and the named company each act as independent data controllers. Sigma is not responsible for, and has no control over, the named company’s independent processing of your data.
- Sigma will process your data as set out in our privacy policy available at https://www.sigmarecruitment.co.uk/privacy-policy/.
5. Candidate Instructions and Rights with the Named Company
- You authorise Sigma to disclose your CV and related information to the named company for recruitment purposes.
- If you wish to exercise your data subject rights (e.g., to delete your data) in respect of processing carried out by the named company, you agree to raise this directly with them.
6. Site Attendance and On‑site Risks
- You acknowledge that interviews or meetings may occur at the named company’s premises, which Sigma does not control. You agree to comply with all their health, safety, and security policies.
- To the maximum extent permitted by law, Sigma is not liable for any loss, damage, or injury you suffer in connection with attendance at the named company’s premises, except to the extent caused by Sigma’s own gross negligence. You are responsible for your own travel and insurance.
7. Information, Offers, and Candidate Reliance
- You acknowledge that all communications regarding a potential offer are provisional until you receive and formally accept a written, unconditional contract of employment or engagement directly from the named company.
- You agree that you will not resign from current employment, decline other opportunities, or incur any expense in reliance on any verbal or conditional offer communicated by Sigma. Sigma is not liable for any loss you incur as a result of such premature action.
8. Reference Checks
- You authorise Sigma to procure references you have nominated and provide them to the named company. You acknowledge that Sigma acts as a mere conduit for this information and is not responsible for its accuracy or content. You release Sigma from any liability for loss or damage arising from the content of any reference.
9. Intellectual Property in Submitted Materials
- By submitting any materials (CV, portfolio, code samples, etc.), you grant Sigma and the named company a limited licence solely to review and share them for evaluating your suitability. This does not grant any right for commercial use. You warrant you have the right to share these materials and indemnify Sigma against any claims of IP infringement.
10. Candidate Focus Newsletter and Example Candidate Profile Scheme
- You may be included in our free Candidate Focus newsletter or Example Candidate Profile scheme only if you give explicit permission. Participation means we may create and share a short anonymised profile (no name or contact details) with clients and prospective clients, and we may display it publicly on our website and social media. These profiles are searchable by sector, job title/skills, location, and keywords. We will not share your full CV without your permission.
- Profile content may include details such as experience, industry sectors, education, qualifications, achievements, location, job titles, and salary expectations. You can see examples of how profiles appear on our site here and here (please scroll to the Featured Candidates section).
- To create and distribute profiles, Sigma Recruitment may upload your personal details to AI tools to draft content and to identify relevant companies to receive your profile.
- You may request a copy, amendment, or removal of your profile at any time by emailing info@sigmarecruitment.co.uk and quoting “example candidate remove”. Once permission is granted, later applications or online bookings where you do not re-confirm participation will not automatically remove your profile; you must contact us using the phrase “example candidate remove”. Please contact us urgently if you did not agree to be included.
- Sigma is not obliged to create a profile and may remove it at any time.If you are no longer open to career opportunites please let us know and we can remove your profile, where you don’t do this we will assume you are still interested in career opportunites and are happy for us to market your profile. There is a small chance a third party could infer your identity from the anonymised profile; if you are unhappy with this, you can withdraw at any time. Sigma will not confirm profile identities to third parties without your express permission.
11. Speculative CV Marketing Scheme
- If you give permission to join the Speculative CV Marketing scheme, we may market your CV to third parties, including clients and prospective clients, and may make anonymised details available publicly on our website (excluding your name and contact details).
- To facilitate this marketing, Sigma Recruitment may upload your personal details to AI tools to help create supporting content and identify suitable companies to receive your profile or CV.
- You can request removal, amendments, or a copy of the information shared under this scheme at any time by emailing info@sigmarecruitment.co.uk and quoting “stop cv marketing”. Once you give permission, later applications or bookings where you do not agree to the scheme will not automatically halt activity; you must contact us using the phrase “stop cv marketing”. Please contact us urgently if you did not agree to be included.
- Sigma is not obliged to market any CVs and may cease marketing at any time.
12. Disengagement and Post-Placement
- Sigma’s services and responsibilities conclude upon your acceptance of a formal offer from the named company. Sigma makes no warranty and accepts no liability regarding the work environment, culture, or long-term suitability of the role. Your ongoing rights are governed by your contract with the named company.
13. No Employment Relationship
- These terms do not create an employment, worker, or partnership relationship between you and Sigma. Any contract of employment is between you and the named company.
14. Liability Cap
- Subject to paragraph 15 (Non‑Excludable Liability), Sigma’s total aggregate liability to you arising out of or in connection with these terms or the recruitment process is limited to one pound.
15. Non‑Excludable Liability
- Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including for death or personal injury caused by negligence, or for fraud.
16. Indemnity and Risk Allocation
- You agree to indemnify and hold Sigma harmless against all losses, liabilities, and costs (including legal fees) arising from your breach of these terms or law, any inaccuracy in information you provide, or the named company’s independent processing of your data, except where caused by Sigma’s gross negligence.
- Sigma is not liable for any indirect or consequential losses (e.g., loss of profit or opportunity).
17. Compliance and Cooperation
- You agree to promptly provide information reasonably requested by Sigma to comply with law or client requirements, and to inform Sigma of any conflicts.
18. Termination
- Sigma may withdraw representation at any time. Your exclusivity and confidentiality obligations continue for 12 months from your affirmative reply.
19. Severability, Modification, and “Blue Pencil”
- If any part of these terms is found by a court to be invalid, illegal, or unenforceable, that part may be severed (the “blue pencil test”), or the court may modify it to the minimum extent necessary to make it valid and enforceable. The validity and enforceability of the rest of these terms will not be affected.
20. Entire Agreement and No Waiver
- These terms constitute the entire agreement between you and Sigma for this representation, superseding all prior discussions. No failure by Sigma to enforce a term constitutes a waiver of its right to do so later.
21. Governing Law and Jurisdiction
- These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
22. Candidate Acknowledgement
- You acknowledge that Sigma does not provide legal, tax, or immigration advice and you are responsible for your own decisions and compliance.
